Miami's Sewage Problem! New disclosures when selling a home in Miami-Dade County

In this video I discuss the recently enacted ordinance regarding septic tanks in Miami-Dade County.

On July 21, 2021, Miami-Dade County passed Ordinance Section 21-49.1 ("Ordinance")which requires sellers of real property that contain septic tank systems to provide to the purchase certain disclosures. A copy of the Ordinance can be found here.

The Ordinance became effective on July 30, 2021 and requires that the disclosure be provided prior to entering into contract and also requires that the instrument conveying title contain language regarding the septic tank system. The Ordinance provides for the issuance of fines against any Seller who violates any provision of the Ordinance.
